ci: back off and retry on GitHub API rate limits in PR Gate and Vercel guard - #3567
One shared cause: PR CI pollers exhausted the repo's GitHub App installation REST budget (5000/hr). After the 7:13 PM PT sync pushed new heads to about 25 PRs at once, every PR started:
PR Gate Backend/Frontend: lewagon/wait-on-check-action polling every 30s, which crashes on the first 403 (Octokit::TooManyRequests), e.g. jobs 120753780345, 120751288971, 120751451860, 120758641269.
Once the budget hit 0 (x-ratelimit-used 5000), PR Gate failed, so CI Status Gate failed, and Vercel guard runs failed with 403 (jobs 120758641210, 120751436886).
Fix
pr-gate.yml: replace wait-on-check-action with a github-script wait that uses check_name filtering, exponential backoff (30s, x1.5, cap 120s), and treats 403/429 rate limits as wait until reset and retry, never failure, until the 40 min deadline.
vercel-preview-guard.yml: same rate limit retry helper, backoff 20s x1.5 cap 60s, and status/check lookups only every other loop.
actionlint passes (remaining shellcheck infos are pre-existing on main).
Note
Medium Risk
Changes how required merge-gate workflows poll GitHub; incorrect wait/retry logic could block merges or mask real CI failures, but scope is CI-only with no application runtime impact.
Overview
Replaces lewagon/wait-on-check-action in PR Gate (backend and frontend jobs) with inline actions/github-script polling for Backend/Frontend CI Status Gate, so rate-limited GitHub API responses no longer fail the gate immediately.
The new wait loop polls checks.listForRef with check_name filtering for up to 40 minutes, uses exponential poll backoff (30s → ×1.5, cap 120s), and wraps API calls in a shared callWithRetry helper that sleeps through 403/429 rate limits (using Retry-After / x-ratelimit-reset) and retries transient errors with bounded backoff.
vercel-preview-guard.yml gets the same callWithRetry pattern around deployment/status/commit-status/check calls, variable sleep backoff (20s → ×1.5, cap 60s instead of fixed 15s), and commit status + check lookups only on every other poll to cut REST usage during mass PR updates.
Reviewed by Cursor Bugbot for commit a7debab. Bugbot is set up for automated code reviews on this repo. Configure here.
The PR gate now polls backend and frontend checks through the GitHub API. The Vercel preview guard retries API requests and changes its polling schedule for deployment and check data.
The new PR gate can decide from a stale check result, and permission errors from GitHub can be mistaken for rate limits. A real authorization failure would then hold a runner for up to 25-40 minutes and report only a timeout. Fix the newest-run selection and narrow the 403 rate-limit test before merging.

Review details
Before / after behavior
observed — Modified behavior in .github/workflows/pr-gate.yml: The backend wait step replaces wait-on-check-action and its 30-minute check-discovery window with GitHub API polling for the latest Backend CI Status Gate check on the PR head SHA. It waits up to 40 minutes, backs off polling intervals from 30 seconds to a 120-second cap, and succeeds only for a completed success conclusion; other completed conclusions and timeout fail the step. API errors retry up to three times with exponential backoff, while detected rate limits use available retry/reset headers or a 60-second default, bounded by the deadline.
observed — Modified behavior in .github/workflows/pr-gate.yml: The frontend wait step makes the same replacement for Frontend CI Status Gate: it polls the latest check on the PR head SHA for up to 40 minutes, succeeds only on a completed success, and fails on other completed conclusions or timeout. API errors retry up to three times with exponential backoff; rate limits are retried using available retry/reset headers or a 60-second default, with waits bounded by the deadline.
observed — Modified behavior in .github/workflows/vercel-preview-guard.yml: Adds callWithRetry for GitHub API calls. It retries rate limits until the deadline, using Retry-After or reset headers when available and otherwise waiting 60 seconds, capped by remaining time. Other errors get up to three exponential-backoff retries; exhausted retries rethrow the error, while reaching the deadline returns null.
observed — Modified behavior in .github/workflows/vercel-preview-guard.yml: Deployment and deployment-status requests now use callWithRetry; a null result stops polling. The prior direct API calls are removed.

A secondary rate limit without Retry-After can make both PR gates and the Vercel guard sleep until their deadlines and fail without retrying, even while primary quota remains available.

Head confirmed: 127f030. The workflow logic is sound.
Workflow names, job names, on: triggers, permissions ({} at top level, plus job-level contents: read and checks: read) and timeout-minutes are unchanged against main. The only structural diff is ref: -> HEAD_SHA env. No new secrets: it uses github.token instead of secrets.GITHUB_TOKEN. Still pull_request, not pull_request_target. actions/github-script is pinned to 3a2844b7, the same SHA main already uses.
No gate is weakened. Only a completed run with conclusion === 'success' returns success. Any other conclusion triggers setFailed, and a deadline or exhausted retries end in setFailed or a thrown error. Nothing defaults to success, and res === null also falls through to the timeout failure.
The backoff is bounded. Polling grows 30s x1.5 up to a 120s cap (20s up to 60s in the Vercel guard). Non-rate-limit errors get 3 retries (5/10/20s) and then throw. Rate-limit sleeps are clamped to the remaining deadline, which is 40 min (25 min in the guard), inside timeout-minutes 45.
Reset headers: Retry-After is honored as seconds or as an HTTP date, and x-ratelimit-reset as epoch seconds minus now, each plus a 5s buffer. A plain 403 without rate-limit signals is not treated as a rate limit.
Polled names: "Backend CI Status Gate" and "Frontend CI Status Gate", using check_name with filter=latest.
Blocking (scope):
The PR adds a new root uv.lock (virtual regengine 0.4.0) that has nothing to do with the CI fix, and a new lockfile can change uv resolution and sync behavior in other jobs. Drop it from this PR, or raise it separately.
Non-blocking:
The Vercel guard now checks commit status and check conclusions only on even iterations, which delays failure detection by one poll. It never turns a failure into a pass.
CI: at review time, 19 checks were pending, 1 passed, 6 were skipped and none had failed.
The reason will be displayed to describe this comment to others. Learn more.
Delta re-review at a7debab. The head matches and the branch is up to date with main.
Delta from 127f030: one commit (a7debab) that only deletes the root uv.lock (-8 lines). uv.lock is not on main; 127f030 had added it, so this removes the unrelated file.
Against main: only .github/workflows/pr-gate.yml and .github/workflows/vercel-preview-guard.yml differ (+347/-48). Both workflow files are byte-identical to 127f030, with the same blob hashes (30eacf8c… and 21c95ebc…). The workflow changes reviewed as sound at 127f030 are unchanged.
CI was still running at review time (2 pass, 6 pending, 2 skipping, none failing).

The backend and frontend steps contain the same ~105-line script. Only CHECK_NAME differs between them. According to the PR description, the Vercel guard also adds a similar callWithRetry. A fix to the rate-limit classification or the run selection must now go into each copy by hand, and the copies can diverge. Both jobs already run actions/checkout. Put the logic in a file such as .github/scripts/wait-for-check.js and load it with require.

🩺 Stability & Availability | Minor | ⚡ Quick win
Stop classifying every 403 that carries x-ratelimit-reset as a rate limit.
GitHub sends x-ratelimit-reset on nearly every REST response, including ordinary permission 403s such as "Resource not accessible by integration". The current condition therefore treats a real authorization or configuration 403 as a rate limit. The script then sleeps until the reset time, up to about one hour but capped by the deadline. It repeats this until the 40-minute deadline expires. The final message, Timed out waiting for ..., hides the real error, and the run wastes about 40 minutes of runner time.
The checks are also redundant. status === 429 and remaining === '0' appear both outside and inside the parenthesized clause. For a 403, count it as a rate limit only when one of these holds:

<title>Using the REST API to interact with checks - GitHub Docs</title>

<excerpt>citeturn0search7 [wordlim: 200] Crawled: last month; You can use the REST API to build GitHub Apps that run powerful checks against code changes in a repository. ... When your GitHub App receives the `check_suite` event, it can create new check runs for the latest commit. ... A check run is an individual test that is part of a check suite. ... To merge a pull request with checks that are both required and archived, you must rerun the checks.
Check suites summarize the status and conclusion of the check runs that a suite includes.
The `status` can be `queued`, `in_progress`, `requested`, `waiting`, `pending`, or `completed`. Only GitHub Actions can set a status of `requested`, `waiting`, or `pending`.
If the status is `completed`, the conclusion can be any of the following:
* `action_required`
* `cancelled`
* `timed_out`
* `failure`
* `neutral`
* `skipped`
* `stale`
* `startup_failure`
* `success`
The check suite reports the highest priority check run `conclusion` in the check suite's `conclusion`. For example, if three check runs have conclusions of `timed_out`, `success`, and `neutral` the check suite conclusion will be `timed_out`.
By default, GitHub creates a check suite automatically when code is pushed to the repository. This default flow sends the `check_suite` event (with `requested` action) to all GitHub Apps that have the `checks:write` permission. When your GitHub App receives the `check_suite` event, it can create new check runs for the latest commit.
For information on how to authenticate as a GitHub App, see About authentication with a GitHub App.
## About check runs
A check run is an individual test that is part of a check suite. Each run includes a status and conclusion.
The `status` can be `queued`, `in_progress`, `requested`, `waiting`, `pending`, or `completed`. Only GitHub Actions can set a status of `requested`, `waiting`, or `pending`.
If the status is `completed`, the conclusion can be any of the following:
* `action_required`
* `cancelled`
* `timed_out`
* `failure`
* `neutral`
* `skipped`
* `success`
If a check run is in an incomplete state for more than 14 days, then the check run's `conclusion` becomes `stale` and appears on GitHub as stale with . Only GitHub can mark check runs as `stale`. For more information about possible conclusions of a check run, see the `conclusion` parameter.
As soon as you receive the `check_suite` webhook, you can create the check run, even if the check is not complete. </excerpt>

# REST API endpoints for check runs
Use the REST API to manage check runs.
Note
Write permission for the REST API to interact with checks is only available to GitHub Apps. OAuth apps and authenticated users can view check runs and check suites, but they are not able to create them. If you aren't building a GitHub App, you might be interested in using the REST API to interact with commit statuses.
## Create a check run
Creates a new check run for a specific commit in a repository.
To create a check run, you must use a GitHub App. OAuth apps and authenticated users are not able to create a check suite.
In a check suite, GitHub limits the number of check runs with the same name to 1000. Once these check runs exceed 1000, GitHub will start to automatically delete older check runs.
Note
The Checks API only looks for pushes in the repository where the check suite or check run were created. Pushes to a branch in a forked repository are not detected and return an empty `pull_requests` array.
## List check runs in a check suite

<title>[Bug]: kanban: PR acceptance rejects a green head when a superseded workflow run left a cancelled check run on the same commit · Issue #122688 · NousResearch/hermes-agent · GitHub</title>
<location>GitHub issue 122688 in NousResearch/hermes-agent (link omitted to avoid creating a cross-reference)</location>
<excerpt>citeturn1search6 [wordlim: 200] Published: 4 weeks ago; Crawled: last week; # [Bug]: kanban: PR acceptance rejects a green head when a superseded workflow run left a cancelled check run on the same commit #122688 ... * Line 74 uses `filter=latest`, which GitHub applies per check suite, so several same-name runs survive.
A workflow can be re-triggered on the same commit, for example by `ready_for_review` after a draft push, under a `concurrency` group with `cancel-in-progress`. The head then carries a cancelled run from the superseded suite and a successful run from the new suite. Acceptance classifies the cancelled run as `infra` and rejects completion, even though the required check is green.
## Environment
hermes-agent v0.21.4 (Docker). The code below is unchanged on `origin/main` at `59004a62356f`.
## Reproduce
1. A required check (say `Release Policy`) comes from a workflow with `concurrency: { cancel-in-progress: true }`.
2. Push to a draft PR, which starts run A. Mark the PR ready (`gh pr ready`), which starts run B on the same head SHA and cancels A.
3. Run B concludes `success`. `GET /repos/O/R/commits/<sha>/check-runs?filter=latest` now returns both `Release Policy` runs, one per check suite: A `cancelled`, B `success`.
4. Call `kanban_complete` on a card with `completion_contract=O/R`.
Actual:
* `pr_acceptance` is classified `infra`, and completion is rejected with "Fix required failures, rerun infrastructure checks or wait, then retry completion".
* The saved error then trips the dispatcher's `blocker_auth` respawn guard (see kanban: respawn_guarded is logged on every tick, and a rejected complete can release blocker_auth #121651 and kanban respawn guard: `auth\w*` matches `author`, and the hold has no terminal state #117009), so the card sits held until an operator clears it.
Expected: the newest run per required context decides. The cancelled, superseded run doesn't count.
## Root cause
In `hermes_cli/kanban_pr_acceptance.py` at `59004a62`:
* Line 74 uses `filter=latest`, which GitHub applies per check suite, so several same-name runs survive.
* Lines 81–85 select all matching runs (`selected = matching + …`).
* Lines 89–103 let any non-success run decide the card's classification.
* `_classify` (line 117) maps `cancelled` to `infra`.
Legacy commit statuses already pick the newest entry (`max(legacy, key=lambda s: s["id"])`, line 85). Check runs don't.
## Suggested fix
For each required context (and pinned app id), select the single most recent check run before classifying: by `started_at`, then by `id`. </excerpt>

Pick the newest check run before evaluating its conclusion.
runs.find(r => r.status === 'completed') can select an older completed run while a newer run for the same check name is queued or in progress. This can fail the gate from a stale result or pass it before the newer run finishes.
Apply the same change to the frontend polling step.

Update the check-run selection in the polling logic to evaluate the newest run,
not the first completed run, so a newer queued or in-progress run cannot be
bypassed by a stale result. Apply this to both the shown check-run logic and the
frontend polling step, preserving existing success and failure handling for
completed runs.

Narrow the 403 rate-limit test. Permission 403 errors are retried as rate limits.
GitHub sends x-ratelimit-reset on every REST response, not only on rate-limited ones. The test headers['x-ratelimit-reset'] != null is therefore true for every 403 error. That includes a permanent "Resource not accessible by integration" 403 from a missing permission or a token restriction.
In that case the code sleeps until the reset time, which can be up to an hour away and is capped at the 25-minute deadline. callWithRetry then returns null, and the loop ends with "No ready regengine Vercel preview ... after 25 minutes". The real 403 cause is never reported, and the job holds a runner for the whole window.
The status === 403 || status === 429 wrapper also repeats checks that the lines above it already make. remaining === '0' appears three times.
Use signals that only appear on real rate limits:
remaining === '0'
a retry-after header
a secondary-limit message
Do not use the always-present reset header as a trigger. Keep it only to compute the wait time.
The status-code checks follow the learning that 403 is a permanent client error unless an explicit rate-limit signal is present. The message match is a secondary signal for 403 only.

Update the isRateLimit check to treat 429 responses as rate limits and 403
responses as rate limits only when remaining is zero, a retry-after header is
present, or the error message indicates a secondary rate limit. Remove the
reset-header test and redundant checks from rate-limit detection, while
preserving reset headers for calculating wait times.

Do not retry permanent 4xx errors.
This branch retries every non-rate-limit error up to three times. That includes 404, 401, and 422 responses. Retries will not fix these, and they delay the real failure by about 35 seconds (5s, 10s, and 20s). Retry only network errors with no status, and 5xx responses.
Based on learnings: only retry transient failures (5xx and network errors). Do not retry generic 4xx responses.

Update the retry branch using `otherRetries` so it retries only transient
failures: network errors with no `status` and responses with status 500 or
higher. Let other 4xx errors, including 401, 404, and 422, proceed without
retrying.

Stale check run can finish wait
Medium Severity
The waiter treats the first completed row from listForRef as final instead of the newest run. An older completed Backend CI Status Gate or Frontend CI Status Gate can pass or fail the gate while a newer run for the same check_name is still in progress.

Rate limit wait uses primary reset
Medium Severity
A 403 classified as a rate limit without retry-after always sleeps until x-ratelimit-reset. That header is the primary hourly window and is present on almost every GitHub error, so a secondary limit that still has remaining quota can stall until the 40-minute deadline and time out.

Root cause
One shared cause: PR CI pollers exhausted the repo's GitHub App installation REST budget (5000/hr). After the 7:13 PM PT sync pushed new heads to about 25 PRs at once, every PR started:
Preview – regengine, while Vercel now createsPreview, so it never matched and polled the full 25 min ("No ready regengine Vercel preview for after 25 minutes", e.g. run 40053110641 on feat(copy): SEL-452 copy gate with capabilities registry and baseline ratchet #3549, even though deployment 7292726004 was ready).Once the budget hit 0 (x-ratelimit-used 5000), PR Gate failed, so CI Status Gate failed, and Vercel guard runs failed with 403 (jobs 120758641210, 120751436886).
Fix
check_namefiltering, exponential backoff (30s, x1.5, cap 120s), and treats 403/429 rate limits as wait until reset and retry, never failure, until the 40 min deadline.Affected PRs
#3549 #3530 #3544 #3542 #3551 #3558 #3527 #3523. Their heads predate #3531 and #3540; they need main merged in (no rebase) after this lands.
actionlint passes (remaining shellcheck infos are pre-existing on main).
Note
Medium Risk
Changes how required merge-gate workflows poll GitHub; incorrect wait/retry logic could block merges or mask real CI failures, but scope is CI-only with no application runtime impact.
Overview
Replaces
lewagon/wait-on-check-actionin PR Gate (backend and frontend jobs) with inlineactions/github-scriptpolling for Backend/Frontend CI Status Gate, so rate-limited GitHub API responses no longer fail the gate immediately.The new wait loop polls
checks.listForRefwithcheck_namefiltering for up to 40 minutes, uses exponential poll backoff (30s → ×1.5, cap 120s), and wraps API calls in a sharedcallWithRetryhelper that sleeps through 403/429 rate limits (usingRetry-After/x-ratelimit-reset) and retries transient errors with bounded backoff.vercel-preview-guard.ymlgets the samecallWithRetrypattern around deployment/status/commit-status/check calls, variable sleep backoff (20s → ×1.5, cap 60s instead of fixed 15s), and commit status + check lookups only on every other poll to cut REST usage during mass PR updates.Reviewed by Cursor Bugbot for commit a7debab.
