🩺 Stability & Availability | Minor | ⚡ Quick win

Stop classifying every 403 that carries x-ratelimit-reset as a rate limit.

GitHub sends x-ratelimit-reset on nearly every REST response, including ordinary permission 403s such as "Resource not accessible by integration". The current condition therefore treats a real authorization or configuration 403 as a rate limit. The script then sleeps until the reset time, up to about one hour but capped by the deadline. It repeats this until the 40-minute deadline expires. The final message, Timed out waiting for ..., hides the real error, and the run wastes about 40 minutes of runner time.

The checks are also redundant. status === 429 and remaining === '0' appear both outside and inside the parenthesized clause. For a 403, count it as a rate limit only when one of these holds:

  • remaining === '0' (primary limit)
  • retry-after is present (secondary limit)
  • the message mentions a rate limit

Update the `isRateLimit` checks in both retry steps to avoid treating ordinary
403 responses as rate limits merely because they include a rate-limit reset
header. Keep status 429 classified as a rate limit; classify status 403 only
when `remaining` is zero, a `Retry-After` header is present, or the error
message mentions a rate limit. Remove the redundant conditions and reset-header
checks.

A secondary rate limit without Retry-After can make both PR gates and the Vercel guard sleep until their deadlines and fail without retrying, even while primary quota remains available.

Rate limit wait uses primary reset

Medium Severity

A 403 classified as a rate limit without retry-after always sleeps until x-ratelimit-reset. That header is the primary hourly window and is present on almost every GitHub error, so a secondary limit that still has remaining quota can stall until the 40-minute deadline and time out.

Stale check run can finish wait

Medium Severity

The waiter treats the first completed row from listForRef as final instead of the newest run. An older completed Backend CI Status Gate or Frontend CI Status Gate can pass or fail the gate while a newer run for the same check_name is still in progress.

## List check runs for a Git reference

Lists check runs for a commit ref. The `ref` can be a SHA, branch name, or a tag name.

Note

The endpoints to manage checks only look for pushes in the repository where the check suite or check run were created. Pushes to a branch in a forked repository are not detected and return an empty `pull_requests` array.

If there are more than 1000 check suites on a single git reference, this endpoint will limit check runs to the 1000 most recent check suites. To iterate over all possible check runs, use the List check suites for a Git reference endpoint and provide the `check_suite_id` parameter to the List check runs in a check suite endpoint.

OAuth app tokens and personal access tokens (classic) need the `repo` scope to use this endpoint on a private repository.

<title>Using the REST API to interact with checks - GitHub Docs</title>
<location>https://docs.github.com/en/rest/guides/using-the-rest-api-to-interact-with-checks?apiVersion=2026-03-10</location>
<excerpt>citeturn0search7 [wordlim: 200] Crawled: last month; You can use the REST API to build GitHub Apps that run powerful checks against code changes in a repository. ... When your GitHub App receives the `check_suite` event, it can create new check runs for the latest commit. ... A check run is an individual test that is part of a check suite. ... To merge a pull request with checks that are both required and archived, you must rerun the checks.
Check suites summarize the status and conclusion of the check runs that a suite includes.

The `status` can be `queued`, `in_progress`, `requested`, `waiting`, `pending`, or `completed`. Only GitHub Actions can set a status of `requested`, `waiting`, or `pending`.

If the status is `completed`, the conclusion can be any of the following:

  * `action_required`
  * `cancelled`
  * `timed_out`
  * `failure`
  * `neutral`
  * `skipped`
  * `stale`
  * `startup_failure`
  * `success`

The check suite reports the highest priority check run `conclusion` in the check suite&#39;s `conclusion`. For example, if three check runs have conclusions of `timed_out`, `success`, and `neutral` the check suite conclusion will be `timed_out`.

By default, GitHub creates a check suite automatically when code is pushed to the repository. This default flow sends the `check_suite` event (with `requested` action) to all GitHub Apps that have the `checks:write` permission. When your GitHub App receives the `check_suite` event, it can create new check runs for the latest commit.
For information on how to authenticate as a GitHub App, see About authentication with a GitHub App.

## About check runs

A check run is an individual test that is part of a check suite. Each run includes a status and conclusion.

The `status` can be `queued`, `in_progress`, `requested`, `waiting`, `pending`, or `completed`. Only GitHub Actions can set a status of `requested`, `waiting`, or `pending`.

If the status is `completed`, the conclusion can be any of the following:

  * `action_required`
  * `cancelled`
  * `timed_out`
  * `failure`
  * `neutral`
  * `skipped`
  * `success`

If a check run is in an incomplete state for more than 14 days, then the check run&#39;s `conclusion` becomes `stale` and appears on GitHub as stale with . Only GitHub can mark check runs as `stale`. For more information about possible conclusions of a check run, see the `conclusion` parameter.

As soon as you receive the `check_suite` webhook, you can create the check run, even if the check is not complete. </excerpt>

# REST API endpoints for check runs

Use the REST API to manage check runs.

Note

Write permission for the REST API to interact with checks is only available to GitHub Apps. OAuth apps and authenticated users can view check runs and check suites, but they are not able to create them. If you aren&#39;t building a GitHub App, you might be interested in using the REST API to interact with commit statuses.

## Create a check run

Creates a new check run for a specific commit in a repository.

To create a check run, you must use a GitHub App. OAuth apps and authenticated users are not able to create a check suite.

In a check suite, GitHub limits the number of check runs with the same name to 1000. Once these check runs exceed 1000, GitHub will start to automatically delete older check runs.

Note

The Checks API only looks for pushes in the repository where the check suite or check run were created. Pushes to a branch in a forked repository are not detected and return an empty `pull_requests` array.
## List check runs in a check suite

<title>[Bug]: kanban: PR acceptance rejects a green head when a superseded workflow run left a cancelled check run on the same commit · Issue #122688 · NousResearch/hermes-agent · GitHub</title>

<excerpt>citeturn1search6 [wordlim: 200] Published: 4 weeks ago; Crawled: last week; # [Bug]: kanban: PR acceptance rejects a green head when a superseded workflow run left a cancelled check run on the same commit #122688 ... * Line 74 uses `filter=latest`, which GitHub applies per check suite, so several same-name runs survive.
A workflow can be re-triggered on the same commit, for example by `ready_for_review` after a draft push, under a `concurrency` group with `cancel-in-progress`. The head then carries a cancelled run from the superseded suite and a successful run from the new suite. Acceptance classifies the cancelled run as `infra` and rejects completion, even though the required check is green.

## Environment

hermes-agent v0.21.4 (Docker). The code below is unchanged on `origin/main` at `59004a62356f`.

## Reproduce

  1. A required check (say `Release Policy`) comes from a workflow with `concurrency: { cancel-in-progress: true }`.
  2. Push to a draft PR, which starts run A. Mark the PR ready (`gh pr ready`), which starts run B on the same head SHA and cancels A.
  3. Run B concludes `success`. `GET /repos/O/R/commits/&lt;sha&gt;/check-runs?filter=latest` now returns both `Release Policy` runs, one per check suite: A `cancelled`, B `success`.
  4. Call `kanban_complete` on a card with `completion_contract=O/R`.

Actual:

  * `pr_acceptance` is classified `infra`, and completion is rejected with &quot;Fix required failures, rerun infrastructure checks or wait, then retry completion&quot;.
  * The saved error then trips the dispatcher&#39;s `blocker_auth` respawn guard (see kanban: respawn_guarded is logged on every tick, and a rejected complete can release blocker_auth #121651 and kanban respawn guard: `auth\w*` matches `author`, and the hold has no terminal state #117009), so the card sits held until an operator clears it.

Expected: the newest run per required context decides. The cancelled, superseded run doesn&#39;t count.

## Root cause

In `hermes_cli/kanban_pr_acceptance.py` at `59004a62`:

  * Line 74 uses `filter=latest`, which GitHub applies per check suite, so several same-name runs survive.
  * Lines 81–85 select all matching runs (`selected = matching + …`).
  * Lines 89–103 let any non-success run decide the card&#39;s classification.
  * `_classify` (line 117) maps `cancelled` to `infra`.

Legacy commit statuses already pick the newest entry (`max(legacy, key=lambda s: s[&quot;id&quot;])`, line 85). Check runs don&#39;t.

## Suggested fix

For each required context (and pinned app id), select the single most recent check run before classifying: by `started_at`, then by `id`. </excerpt>

Pick the newest check run before evaluating its conclusion.

runs.find(r => r.status === 'completed') can select an older completed run while a newer run for the same check name is queued or in progress. This can fail the gate from a stale result or pass it before the newer run finishes.

Update the check-run selection in the polling logic to evaluate the newest run,
not the first completed run, so a newer queued or in-progress run cannot be
bypassed by a stale result. Apply this to both the shown check-run logic and the
frontend polling step, preserving existing success and failure handling for
completed runs.

📐 Maintainability & Code Quality | Trivial | ⚡ Quick win

Move the polling script into one shared file.

The backend and frontend steps contain the same ~105-line script. Only CHECK_NAME differs between them. According to the PR description, the Vercel guard also adds a similar callWithRetry. A fix to the rate-limit classification or the run selection must now go into each copy by hand, and the copies can diverge. Both jobs already run actions/checkout. Put the logic in a file such as .github/scripts/wait-for-check.js and load it with require.

Review comment at @.github/workflows/pr-gate.yml around lines 121 - 229:
Extract the duplicated check-polling logic, including callWithRetry and the
polling loop around github.rest.checks.listForRef, into one shared script.
Update the backend and frontend workflow steps to load and invoke it with their
existing GitHub context, core, SHA, and check name, keeping CHECK_NAME-specific
behavior parameterized.
